Refund Policy
This Refund Policy applies to all users of the VCS Funding, operated by VCS Funding ("us"), and governs the terms under which refunds may be issued in connection with investments made via VCS Funding.
1. Regulatory Position
VCS Funding operates as an introducer platform and does not provide regulated investment advice or act as a financial intermediary unless expressly stated otherwise. Nothing on this Platform constitutes a recommendation or financial promotion under the Financial Services and Markets Act 2000 (“FSMA”) unless explicitly specified.
Investors are responsible for ensuring that they comply with all applicable UK laws and regulations, including those enforced by the Financial Conduct Authority (FCA).
2. Nature of Investments
All investments made through the platform are risk and illiquid. By investing, you acknowledge that:
- You may lose part of your invested capital
- Investments are not covered by the Financial Services Compensation Scheme (FSCS)
- Investments are not protected under the Financial Ombudsman Service (FOS)
All investments are therefore final and non-refundable, except as expressly set out in this policy.
3. No Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, financial services relating to price fluctuations in financial markets are exempt from statutory cancellation rights. Accordingly:
- You do not have a statutory cooling-off period once an investment is confirmed
- You expressly waive any right to cancel once funds are committed
4. Platform Role and Due Diligence
VCS Funding performs reasonable commercial due diligence on companies listed on the Platform to mitigate the risk of fraud or misrepresentation. However:
- We do not guarantee the accuracy, completeness, or reliability of any information provided
- We do not verify all statements made by companies
- We do not guarantee investment outcomes or returns
Nothing on the Platform constitutes legal, financial, or investment advice.
5. Limited Refund Circumstances
Refunds will only be considered in the following strictly limited circumstances:
- Duplicate payments caused by a verifiable technical error
- Unauthorised transactions reported without undue delay in accordance with the Payment Services Regulations 2017
- System failures directly attributable to the Platform preventing proper transaction execution
All refund requests must be submitted in writing within 7 calendar days of the transaction date.
6. Investor Responsibility
By using the Platform, you confirm that:
- You have sufficient knowledge and experience to evaluate investment risks
- You have conducted your own independent due diligence
- You understand that investments are speculative and may result in loss.
You are strongly encouraged to seek independent advice from a qualified financial adviser regulated by the FCA.
7. No Liability for Investment Performance
To the fullest extent permitted by law, VCS Funding disclaims all liability for:
- Loss of capital
- Loss of profits or anticipated returns
- Business failure or insolvency of investee companies
Nothing in this policy excludes liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded under UK law.
8. Disputes Between Investors and Companies
VCS Funding is not a party to any investment agreement between investors and companies. Any disputes must be resolved directly between the relevant parties or escalated to customer support. We accept no responsibility for the performance or obligations of any company listed on the Platform with the consent of customer support.
9. Refund Processing
Where a refund is approved:
- Refunds will be processed within 7–14 business days
- Funds will be returned via the original payment method, where feasible
- We reserve the right to deduct any applicable transaction or administrative fees
10. Amendments
We reserve the right to amend or update this Refund Policy at any time. Continued use of the Platform constitutes acceptance of the updated terms.
11. Governing Law
This Refund Policy shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with this policy shall be subject to the exclusive jurisdiction of the courts of England and Wales.
